Judge Blocks Minnesota’s Attempt to Extradite ICE Agent from Texas

Extradition Blocked by Federal Judge

In Dallas, a federal judge has stopped Minnesota’s efforts to extradite Christian Castro, an ICE agent, from Texas. Castro is facing charges linked to a shooting incident involving a Venezuelan migrant during Operation Metro Surge in Minneapolis last January. Meanwhile, Texas Governor Greg Abbott is investigating whether Castro qualifies as a fugitive.

Federal Charges Against ICE Agent

Federal prosecutors have leveled charges against Castro for allegedly lying about the events around the shooting of Julio Cesar Sosa-Celis on January 14. A federal grand jury in Minnesota indicted him last Wednesday, citing false statements connected to the shooting incident, which saw Sosa-Celis injured in the leg.

Castro reportedly fired through the front door of a Minneapolis residence, hitting Sosa-Celis, and subsequently misled investigators about the pre-shooting circumstances. The incident occurred during the Trump administration’s intensified actions against illegal immigration in Minnesota.

Texas Governor’s Intervention

Following Castro’s release from a Texas jail, Texas Governor Greg Abbott declined to issue an extradition warrant to transfer him to Minnesota authorities. Texas law mandates that without extradition, Castro must be freed after a 90-day detention period. Minnesota Attorney General Keith Ellison’s request for a restraining order seeking Castro’s return to Minnesota didn’t succeed.

Legal and Civil Rights Implications

Separately, Castro faces charges in Minnesota for assault and false crime reporting concerning the same shooting. Initial accusations claimed Sosa-Celis and another individual attacked an officer with a broom and a shovel. However, these charges were dismissed following video evidence indicating potential officer misconduct, sparking further inquiry.

ProPublica noted federal prosecutors were restricted by Washington officials from pursuing civil rights charges against Castro.
