Legal Developments in Lindsay Clancy Mistrial

Lindsay Clancy’s legal case in Plymouth, Massachusetts faces developments as her defense team and state prosecutors agree to postpone a motion concerning a holdout juror from her mistrial. The motion, filed by defense attorney Kevin Reddington, seeks to investigate juror Michael Desronvil. The agreement needs approval from Judge William Sullivan, who has not yet issued a decision.

Edward Paltzik, Clancy’s counsel, explained the delay was necessary because the juror’s attorney lacked access to impounded information required for a response. Despite the delay, a status conference is still expected. However, the motion about Desronvil is unlikely to be addressed immediately.

“The DA and Reddington consent to adjourn the motion to investigate Michael,” Paltzik said. “If Judge Sullivan signs an order today, much of it could be adjourned. Either way, a status conference is still likely. But the motion about Michael is likely not on tomorrow.”

The juror Michael P. Desronvil previously forced a mistrial when he stood by his belief that Clancy was guilty of murdering her three children. This stance was contrary to the other eleven jurors who found her not guilty due to mental illness, citing postpartum psychosis as raised by Reddington.

Clancy faces charges of first-degree murder in the deaths of her children, Cora, Dawson, and Callan, at their Duxbury home this past January. Desronvil has retained a lawyer with experience representing former President Donald Trump.

The upcoming hearing is set for 9 a.m. Tuesday, marking Clancy’s first court appearance since the September 4 deadlock among jurors. The hearing anticipates discussion of Reddington’s motion for inquiry into Desronvil, as well as a double jeopardy motion to dismiss charges rather than retry the case.

Paltzik addressed concerns about Reddington’s decision during jury selection, questioning why he did not object to Desronvil as a juror. With 12 jurors and four alternates, Reddington had 16 strikes available for juror removal before trial commenced.
