Former Congressman George Santos faces a lifetime ban from the prediction market site, Kalshi, following accusations of insider trading. An investigation revealed that Santos misled the public for profit, related to his attendance at President Trump’s State of the Union address.

Kalshi, a federally licensed prediction market company, penalized Santos with a fine of $71,356. Santos reacted on social media platform X, challenging the future of Kalshi.

Investigative news first reported federal scrutiny into Santos’s trades concerning the State of the Union market. Santos had claimed he would be attending the event, while he had already bet against his attendance, making over $17,000 in profit.

The Commodity Futures Trading Commission directed Santos to return his profits and imposed an additional penalty of $17,500.

Santos, known for fabricating aspects of his life, was expelled from Congress in 2023. He later pleaded guilty to wire fraud and identity theft but had his prison sentence commuted.

Kalshi also suspended other political candidates who engaged in similar betting activities. Laurie Buckhout, a Congressional candidate, received a fine and a three-year suspension. Billionaire Stephen Cloobeck and Ben Midgley also faced similar repercussions for betting on their own campaigns.

Additionally, Kalshi’s main rival, Polymarket, terminated its association with Santos following the investigation.

The crackdown follows a broader regulatory push, involving the settlement of Gabriel Perez, President Trump’s former teleprompter operator, who profited from insider information.

The legality of prediction market operations is under scrutiny, with platforms largely self-policing. The Commodity Futures Trading Commission has initiated legal challenges against states treating these markets as gambling, sparking a federal debate on their status.

Recent court decisions further fuel the national debate. The 9th Circuit Court of Appeals supported Nevada’s decision to ban Kalshi as a gambling operation, conflicting with a previous favorable ruling for Kalshi by the 3rd Circuit Court.

Following these events, 44 states petitioned the Trump administration addressing concerns over the impact of prediction markets on vulnerable populations.
