FTC Proposes New Policy on Surveillance Pricing

Users often experience price fluctuations when searching for online deals. This is caused by ‘surveillance pricing,’ where companies adjust costs based on personal data to find your ‘pain point’ – the maximum price you’re willing to pay.

Despite the frustration it might cause, urgency often leads consumers to accept higher prices. To address this, the Federal Trade Commission (FTC) proposed a policy requiring transparency when using personal data to set prices. The public comment period on this proposed policy ends September 18.

Intense debate surrounds surveillance pricing. Consumers express dissatisfaction with practices that lead to drastic price changes influenced by personal data.

Examples provided by the commission include hikes in prices for baby products for new parents or increased food delivery costs for home-bound individuals. Although outright bans on these practices are beyond the FTC’s remit without additional legislation, enforcement can ensure transparency.

States like Maryland and New Jersey introduce laws preventing personalized pricing based on consumer data. California is also considering similar legislation.

Critics argue such practices exploit consumers and cause unwarranted financial burdens, while businesses claim the data assists in offering personalized deals.

A shift in how personal data influences pricing continues to evolve, prompting state-level intervention and consumer advocacy.
