U.S. District Judge Emily Marks criticized the rhetoric from lawyers in a criminal case initiated by the Trump administration against the Southern Poverty Law Center (SPLC). She expressed that the arguments resembled the type of discourse more suited for cable news rather than a federal courtroom.
Despite the SPLC’s efforts to dismiss the Trump administration’s fraud allegations, Judge Marks determined that the civil rights group failed to prove that the prosecution had an unconstitutional bias against them. Instead, she emphasized the unsuitability of the legal arguments presented by both sides.

Judge Marks rejected the SPLC’s assertion that the prosecution was vindictive and politically motivated. She found that the SPLC did not meet the legal standard to demonstrate that the Justice Department acted with unconstitutional animus toward them. Marks also denied the SPLC’s attempt to investigate the government’s motives further.
“Federal courts are not the proper forum for airing political grievances,” Marks stated in her ruling. She pointed out that the doctrine of vindictive prosecution imposes a heavy burden on the accused and that the precedent does not support its application in this case.
Moreover, Judge Marks noted that the SPLC presented no objective evidence showing that the United States Attorney’s Office prosecuted them for exercising their First Amendment rights. SPLC had cited public criticism from President Donald Trump and other administration officials, but Marks found no indication that such opinions influenced the prosecutors.
SPLC Faces Multiple Charges
The Justice Department charged the SPLC with 11 criminal counts, including wire fraud, making false statements, and conspiracy to commit money laundering. The government maintains these charges, while the SPLC denies them, claiming the prosecution is politically driven.
An SPLC spokesperson stated their disappointment with the decision but voiced determination to continue defending their organization and its mission.
The latest ruling allows the criminal proceedings against the SPLC to proceed.
Judge Marks Critiques Both Parties
Judge Marks repeatedly criticized the politicized nature of the dispute. She objected to both parties’ personal attacks and focus on public statements instead of legal evidence. Marks highlighted the use of ad hominem attacks through media and social channels by both parties.
She emphasized that federal courts should focus on applying the relevant legal standards to the evidence, not serve as a venue for political disputes. Marks pointed out that President Trump’s broad-ranging rhetoric, although critical of the SPLC, does not prove any bias on the part of the prosecutors.
