Surrogacy Dispute: Parents Seek Compensation From Surrogate

The biological parents of a child born in a contentious surrogacy case are pursuing over $100,000 from the surrogate for breaching their agreement. The couple, Nausheen Gilkar and Omar Ahmed, filed a countersuit against McKenna West, the surrogate mother, claiming she violated the terms of their contract.

TMZ reported the couple’s legal action, which follows a severe conflict after West resisted a request to terminate the pregnancy. The couple alleges that they paid West $60,000 and that the surrogacy contract included clauses related to ending the pregnancy.

West, supported by pro-life advocates, contends her actions were justified as she refused the couple’s demand for an abortion after the child was diagnosed with a congenital heart defect, hypoplastic left heart syndrome.

The legal battle spans multiple states, with West delivering the baby in Texas. While the child, referred to by West as “Gabriel” and by the parents as “Rumi,” underwent a critical surgical procedure known as the Norwood procedure, tensions rise over parental rights and obligations.

Fox News Digital highlighted Live Action founder Lila Rose’s condemnation of the lawsuit against West, arguing it imposes undue financial strain on her for saving the child’s life.

Legal proceedings continue across Alaska, California, and Texas concerning parental rights. Meanwhile, state intervention ensured the child received necessary medical treatment, emphasizing the legislative focus on protecting the child’s welfare.
