Republican Lawmaker Seeks DOJ Investigation of Jack Smith
On Wednesday, the leading Republican member of the House Judiciary Committee urged the Justice Department to open a criminal investigation into former special counsel Jack Smith. This request arose from allegations that Smith provided false information during a congressional deposition last year. Committee Chairman Jim Jordan, R-Ohio, addressed a letter to acting Attorney General Todd Blanche, asserting that Smith offered intentionally misleading statements that contradicted newly obtained documents from the Senate Judiciary Committee.
The committee, led by Jordan, stated they discovered compelling evidence against Smith. A Justice Department spokesperson acknowledged the referral and affirmed their commitment to investigating all potential criminal activities.
Smith’s Legal Defense and Accusations
Smith faced criticism from former President Donald Trump over his investigations. These investigations targeted Trump’s actions regarding the 2020 election and handling of classified documents. Both cases were dismissed in 2024 after Trump secured a second presidential term.
Attorneys for Smith refuted claims of false statements, stating that he provided accurate and responsive answers during his deposition. They argued the referral was intended to unjustly weaponize the justice system against Smith, a nonpartisan public servant.

During a December 17 deposition, Smith was questioned about seeking warrants for text messages from congressional members. He denied recalling such actions and confirmed only requesting toll records. Rep. Jamie Raskin, D-Md., criticized Jordan’s referral for allegedly misrepresenting facts and stated Republicans never questioned Smith about presidential records.
Smith received criticism following revelations by Senate Republicans that his team reviewed text messages from 44 members of Congress. These messages, procured from the National Archives, spanned October 2020 to January 2021.
Constitutional Concerns and Reactions
The Senate Judiciary Committee raised concerns over potential violations of the Constitution’s Speech and Debate Clause. The alleged mishandling of privileged information by Smith’s team sparked criticisms from committee Chairman Chuck Grassley, R-Iowa. Grassley vowed to question Smith before the committee to hold him accountable.
