Oregon Social Worker Dismissed Over Gender Identity Books Loses First Amendment Case

Background of the Case

Rod Theis, an Oregon social worker, was terminated from his role following the display of children’s books like “He Is He” and “She Is She.” These books supported the concept of biological gender. His subsequent First Amendment case against the school district was unsuccessful. Judge John Owens ruled in favor of the school district, asserting that schools have the authority to control content during work hours.

Allegations of Double Standards

This case has drawn attention due to perceived double standards. While Theis faced consequences for his actions, other teachers reportedly displayed LGBTQ+ content without facing similar repercussions.

Parental Concerns on Classroom Content

Maria Varchetto, a mother from Washington, decided to withdraw her children from an elementary school after a Pride-themed lesson was presented in a music class without parental notification or consent. She shared her experience with Fox News Digital, expressing her frustration over the lack of communication from the school.

Incident at Martha Lake Elementary School

Varchetto revealed that on June 15, her fourth-grade daughter attended a class where a video titled “Why is Pride in June” from the “Queer Kid Stuff” YouTube account was shown. The channel targets young children, offering educational content on LGBTQ+ topics.

The lesson, part of a music class at Martha Lake Elementary School in the Edmonds School District, was presented without prior notice to parents. Varchetto claimed there was no opportunity for opting out of the lesson or reviewing the materials beforehand.

Response from the Edmonds School District

A spokesperson from the Edmonds School District stated that the lesson was not part of a districtwide Pride curriculum. The music lesson was independently developed by a music teacher to highlight contributions from notable musicians, including LGBTQ+ artists.

The spokesperson explained that the objective was to educate students on music and history through the contributions of influential artists. The context of an artist’s background or identity was included as relevant biographical information.

Outcome and Comments

Following this incident, Varchetto expressed anger and disappointment. She criticized the lack of transparency and expressed regret over removing her children from a school environment they enjoyed.

The Edmonds School District emphasized their commitment to ensuring instructional materials are age-appropriate and meet district and state standards. They pledged to work with school administrators to address any concerns raised about classroom instruction.
