The operator of a boat that capsized in New York Harbor, resulting in the death of a mother and her infant daughter, is now facing criminal charges. Authorities are examining whether the vessel was operating as an illegal charter, according to the U.S. Coast Guard.

The incident occurred when a 22-foot Bayliner speedboat overturned at approximately 10:25 p.m. on Saturday near Liberty Island, home to the Statue of Liberty. The Coast Guard reported this tragic event. Before police arrival, 12 individuals were rescued from the water. Subsequently, police divers found the bodies of a 27-year-old woman and her 5-month-old daughter. Both were taken to a hospital where they were declared deceased. The remaining individuals were reported to be in stable condition.

Captain Doreen McCarthy, Commander of the Coast Guard Sector New York, stated, “We are deeply saddened by the tragic loss of life last night, and our thoughts are with the victims’ family and loved ones during this incredibly difficult time.” She expressed gratitude for the prompt assistance from partner agencies and a Good Samaritan vessel that helped rescue survivors.

Manuel Hernandez, aged 46, from New York, has been charged with 13 counts of reckless endangerment, according to police reports. As of Sunday, no contact information for Hernandez was available, and the case has not been entered into online court records.

The names of the deceased have not been disclosed as authorities are notifying family members. The Coast Guard, in collaboration with police, is investigating the incident and aims to hold any lawbreakers accountable. An illegal charter, according to the Coast Guard, is any passenger-for-hire vessel lacking proper credentials, safety equipment, and inspection certification.
