Myra Crosby, known as the ‘egg juror’ in the Alex Murdaugh double-murder trial, is challenging South Carolina authorities for access to sealed records. These records relate to allegations of jury tampering by a court official.
Crosby’s Demand for Transparency
Crosby was dismissed before deliberations in the 2023 trial. On May 18, she filed a motion with the South Carolina Supreme Court. She seeks to lift protective orders that currently shield investigative files associated with former Colleton County Clerk of Court, Rebecca Hill. According to Crosby’s filing, transparency best serves public interest and justice.
Prosecutors’ Admission
The case for jury tampering is concluded, according to prosecutors. 11th Circuit Solicitor Rick Hubbard stated during a plea hearing for Hill that the evidence was insufficient to prosecute jury tampering criminally. Hubbard’s remarks affirm, “We cannot prove that case beyond a reasonable doubt.”
The Protective Order
The court, in January 2024, acknowledged a preference for public access and transparency, but chose confidentiality to protect ongoing investigations.
Crosby’s lawyer, Joseph McCullough, submitted multiple South Carolina Freedom of Information Act requests to several state offices. They aim to obtain the full investigative file about Hill’s alleged jury influence during the Murdaugh trial. Nevertheless, the South Carolina Law Enforcement Division denied these requests, citing the Supreme Court’s protective order.
Defense Efforts for Access
Alex Murdaugh’s defense team is also pursuing access to the records. Attorney Dick Harpootlian revealed a separate motion was filed to use the sealed files in civil litigation against Hill.
Harpootlian stated, “We, Alex Murdaugh’s lawyers, also filed… to allow us access to those files, to subpoena those files.” He differentiates between their active litigation and Crosby’s FOIL request, noting that Crosby has no pending litigation against Hill.
Background and Allegations
Murdaugh’s defense suggests Crosby’s dismissal was part of efforts by Hill to direct the jury towards a guilty verdict. The ‘egg juror’ name arose after Crosby asked to retrieve her eggs and purse post-dismissal, causing laughter in court.
