A lawsuit filed in Delaware claims that Smith, along with business partner David Mosley and their company 413 Solutions, Inc., allegedly defrauded a Native American investor, Kituwah LLC, out of $2.5 million. Kituwah LLC represents the investment and economic development section of the Band of Cherokee Indians.
Details of the Lawsuit
The legal proceedings initiated by Kituwah LLC assert that no repayment has been made, despite the loan being over two years overdue. Kituwah LLC alleges that their funds were utilized to reimburse a different company previously involved in the same venture. The project, known as Project Exodus solar farm, was aimed at integrating Kituwah LLC as a partner with an expectation of funding from the U.S. Department of Energy.
“Kituwah poured substantial time, efforts, and resources in the purported joint venture,” the lawsuit articulates, highlighting the absence of returns on their investment while incurring extra costs on recovery efforts.
Kituwah LLC is demanding damages in excess of $2.5 million, including interest, costs, expenses, and any other determinations made during the trial.
Allegations of a Ponzi Scheme
The lawsuit strongly suggests the venture resembles a Ponzi scheme, with accusations of misleading data and projections presented to Kituwah LLC. They were misled into believing the loan would be repaid swiftly. Further investigation by Kituwah found that the loan was directed towards Wilson Holdings, another entity Smith and the other defendants are associated with through separate investments.
