Embryo Mix-up in Florida: Navigating a Complex Custody Situation

The biological parents of a baby inadvertently born to another couple due to an embryo mix-up in Florida are facing a challenging scenario, according to their attorney. Recently, they reached an arrangement permitting the birth parents to maintain custody, leaving the biological parents in a distressing position. Rob Marcereau, their lawyer, expressed the deep sorrow his clients have experienced over recent months, recognizing that the birth couple also endures hardship.

Marcereau conveyed that his clients, though heartbroken, chose not to pursue custody to avoid legal complications. They love the baby, named Shea, and made this tough decision after multiple meetings with the birth parents, filled with emotional exchanges.

Shea was born in December to Tiffany Score and Steven Mills following in vitro fertilization at the Fertility Center of Orlando in Longwood, Florida. Legal action was taken against the clinic after tests revealed no genetic connection between Shea and her birth parents, Score and Mills. The couple noticed physical features suggesting a South Asian heritage, prompting genetic testing, which confirmed their suspicion.

Efforts to locate the true genetic parents, known in court as Patient 004, succeeded in April. These biological parents will be a part of Shea’s life, as agreed in the custody arrangement. Despite their desire to raise Shea, they considered the considerable legal challenge not in the child’s best interest.

The clinic, now closed, faces scrutiny for this severe IVF oversight, highlighting gaps in regulatory oversight in the U.S. Although rare, embryo mix-ups provide a stark warning within the fertility treatment industry.

Score and Mills have formed a commitment to cultivate an amicable relationship with Shea’s biological parents. Meanwhile, both the Fertility Center of Orlando and its lead reproductive endocrinologist, Dr. Milton McNichol, stand accused by the couple. Plans for a similar lawsuit are in motion by the biological parents due to the ordeal’s impact, which Marcereau describes as an unjust scenario.
