President Trump initiated efforts to secure America’s elections by ordering his administration to develop a plan with specific goals. These goals included verifying voter citizenship, prosecuting election fraud, and ensuring that mail ballots are sent only to verified American citizens.
Judge Indira Talwani’s Opposition
Judge Indira Talwani, appointed by President Obama, has consistently opposed Trump’s election integrity measures. Her resistance led the Supreme Court to overturn her decisions on August 24. However, she defied the Supreme Court’s ruling by reinstating a hold on Trump’s order the following day. Critics believe Talwani’s actions aim to delay or undermine efforts to prevent noncitizens from voting in the upcoming elections.
Trump’s Directives to Federal Agencies
President Trump tasked the Department of Justice (DOJ) and the Department of Homeland Security (DHS) with the prosecution of election fraudsters. Additionally, Trump instructed these agencies to collaborate with the U.S. Postal Service to ensure mail ballots are sent only to verified citizens.
These directives are intended to prevent noncitizens from participating in federal elections, reinforcing the principle that only eligible American citizens can vote.
Legal Challenges and Supreme Court Intervention
In response, Democrats filed lawsuits to challenge Trump’s order, with 23 states and the District of Columbia leading the charge. The League of Women Voters also filed a separate suit echoing similar concerns. Judge Talwani issued injunctions in both cases.
The Supreme Court later intervened, ruling against Talwani’s legal arguments. They found that the states lacked the standing required under Article III of the U.S. Constitution. The court highlighted that the absence of a finalized rule meant there was no tangible harm.
Further Judicial Actions and Criticisms
After the Supreme Court ruling, Judge Talwani continued to resist, issuing an advisory opinion that criticized the Trump administration for finalizing regulations amid her injunction. Despite her challenges, she ultimately rescinded her ruling but remained scrutinized for her actions.
Talwani’s measures have been characterized as judicial activism. Her previous attempts to challenge Congress’s decisions—such as opposition to defunding Planned Parenthood—were reversed by higher courts, showcasing a pattern of controversial rulings.

Concerns about Talwani’s conduct have led calls for her impeachment. Critics demand that higher courts reassign her cases to prevent further obstruction of election security measures.
