She discussed former NBA player Royce White’s satirical approach to the WNBA’s gender policies, accusing the league of hypocrisy. Jenner emphasized the importance of protecting Title IX in her remarks.

The WNBA has faced recent controversy regarding the eligibility of transgender athletes. The league has not provided clear guidelines on whether transgender individuals can participate. In light of this situation, former NBA players Enes Kanter Freedom and Royce White have sought entry into the WNBA.

During the WNBA Draft at The Shed in New York City, Commissioner Cathy Engelbert acknowledged discussions on the transgender issue. However, Engelbert stated that no conclusion had been reached. Jenner commented on this, suggesting that the criteria should be straightforward, “Cathy, XX, you’re in. XY you’re out.”

Jenner has supported the International Olympic Committee’s ban on transgender women competing in female sports. She has cited biological advantages that hormone therapy cannot fully mitigate. Jenner highlighted the need to protect women’s sports, referencing Title IX as a pivotal legislation for women’s equality in sports.

According to the WNBA’s collective bargaining agreement, Article XIII, Section 1(a), only players who are women are eligible. However, this document does not define “woman” or “women”. Additionally, the terms “transgender” and “gender identity” are absent from the 409-page agreement.

A WNBA spokesperson confirmed that a meeting addressed topics, including discussions on transgender athletes. The league condemned bad-faith efforts to demean or marginalize individuals online.
