Texas criminal attorney Dick DeGuerin has been practicing law for six decades. He is currently representing Lee Gilley, a 39-year-old Houston man accused of murdering his pregnant wife, Christa Bauer Gilley. Prosecutors claim that Lee Mongerson Gilley killed Christa, who was nine months pregnant, in October 2024.
Fleeing to Italy
Investigators allege the suspect removed his ankle monitor and fled to Italy in May, just weeks before his trial was to start. “In my 60 years as a criminal defense lawyer, I’ve had clients skip bond, but never like this,” DeGuerin remarked.
Upon arrival in Italy, Gilley was detained by authorities and has remained in a jail cell in Turin. The U.S. initially aimed to extradite him, but Italian courts stalled the process due to the potential for a death penalty sentence.
Extradition Challenges
DeGuerin explained that Italian courts will not extradite if a death penalty is possible. In Texas, the charges against Gilley could result in either death or life imprisonment without parole. On September 18, Harris County prosecutors agreed to drop the death penalty to meet Italian demands.
Despite this, Italy requires written confirmation that the death penalty is entirely off the table. Gilley’s attorney affirmed that Italy could still refuse extradition if life without parole remains a possible sentence.
Legal Proceedings
Gilley, represented by defense attorney Ed McClees, appeared in the 497th District Court in Harris County, charged with capital murder for the deaths of his wife and unborn child. The U.S. has a deadline of September 30 to comply with Italy’s clarification requests. A status conference regarding Gilley’s extradition is scheduled for October 7.
DeGuerin insists Gilley is not guilty of the charges, maintaining the stance that he did not commit the murder.
