Proposed Bill for Parents’ Job-Protected Leave

A new House bill could grant millions of workers additional job-protected leave to attend educational and extracurricular activities involving their children and grandchildren. The legislation, known as the Family Leave for Parental Involvement in Education Act, was introduced by Florida Democratic Representative Frederica Wilson on August 31.

The proposal aims to amend the Family and Medical Leave Act (FMLA) and federal employee leave rules. It would establish a category of leave specifically for parental involvement. Eligible workers could take up to eight hours of leave during any 30-day period and up to 48 hours during a 12-month period. This leave would be separate from existing FMLA leave.

The new category of leave enhances parental involvement in children’s educational activities without affecting traditional family or medical leave.

Newsweek requested comments from Wilson’s office, but did not receive a response in time for publication.

Permitted Use of Leave

Under the bill, eligible employees could use the leave for school conferences, classroom events, school performances, sports activities, scouting programs, and educational meetings. Leave could be taken intermittently, allowing attendance at various events throughout the year. The definition of school encompasses elementary schools, secondary schools, Head Start programs, and childcare facilities.

Employers may require documentation for leave requests and workers must generally provide at least seven days’ advance notice.

While the legislation allows unpaid leave, employers can require workers to substitute it with paid time off, vacation time, personal leave, or sick time. It offers protected time off, not necessarily paid time off.

Eligibility Criteria

Eligibility would follow existing FMLA rules. The bill introduces a new qualifying reason for leave under the FMLA framework. The legislation covers activities involving employees’ children or grandchildren. Similar benefits would extend to eligible federal employees by amending Title 5 of the U.S. Code.

Millions of Americans, including federal and private sector employees eligible under FMLA, could benefit from the proposed time off.

FMLA Leave Details

The Family and Medical Leave Act ensures job-protected leave for eligible employees, without requiring paid leave. Workers can use qualifying leave without losing employment and return to their previous or equivalent positions.

Support and Legislative Process

The prospects for Republican support remain unclear, as there are no cosponsors currently backing the bill. The FMLA, enacted in 1993 under President Bill Clinton, faced Republican opposition due to perceived costs for employers.

President Donald Trump previously signed legislation for paid parental leave for federal employees. The Trump administration also expanded tax-credit incentives for employers offering paid family and medical leave. In the words of Treasury Secretary Scott Bessent, the tax cuts aim to support hardworking Americans in balancing care with earning.

The bill awaits referral to House committees, requiring Republican chairs to initiate a committee vote. The next steps involve gaining support for a full vote in the House.
