The International Criminal Court (ICC) faced a significant change when chief prosecutor Karim Khan was dismissed following a vote by the Assembly of States Parties. This decision came after allegations of sexual misconduct involving a junior female staffer. Despite Khan denying the accusations, 82 of the ICC’s 125 member states voted for his removal.
This marks the first instance of a sitting chief prosecutor being removed from the ICC. The decision adds to the ongoing controversy surrounding Khan, who previously issued arrest warrants against Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant. These warrants were linked to Israel’s actions in Gaza, eliciting strong responses from both Israel and the United States, neither of which are members of the ICC.
“There is no way for something to be consensual when you have such a power disparity,” stated the accuser, identified only as Sarah, during a CNN interview.
The ICC was established in The Hague under the Rome Statute to address cases of genocide, war crimes, crimes against humanity, and aggression when national courts fail to do so. Khan’s removal after Secretary of State Marco Rubio’s efforts to “dismantle” the ICC reflects the tension surrounding the court’s influence and decisions.
Legal challenges are anticipated as Khan’s legal team claims the removal process was legally flawed and politically motivated. Tayab Ali, leading Khan’s defense, argued that due process was ignored and that the U.N. Office of Internal Oversight Services found no misconduct in its investigation. A three-judge panel had previously determined there was no breach of duty by Khan.
Israeli officials have criticized Khan’s actions and removal, stating that the legitimacy of the ICC’s actions against Netanyahu is undermined. Israeli Ambassador to the U.N., Danny Danon, alleged that Khan’s targeting of Israel was an attempt to divert attention from his alleged misconduct.
Anne Bayefsky, president of Human Rights Voices, stated that Khan’s actions have harmed the ICC’s integrity. She highlighted suspicions that Khan’s personal issues influenced his decisions and compromised the credibility of his work on Israel-related cases.
Despite Khan’s removal, the ICC has not indicated any changes regarding the arrest warrants for Netanyahu and Gallant. While requests for comments from Khan’s office remain unanswered, the situation continues to unfold with potential legal battles ahead.
