In a recent appearance on the “I’ve Had It” podcast, Hunter Biden labeled the appointment of Merrick Garland as U.S. attorney general as the “greatest mistake” made by his father, former President Joe Biden, during his time in office. The criticism came while Hunter Biden discussed the actions of Garland’s Department of Justice (DOJ) with host Jennifer Welch.

Welch accused Garland and the DOJ of failing to charge former President Donald Trump, alongside investigating Hunter Biden. She described Democrats’ actions in appointing Garland as a “capitulation” to Republicans. Hunter Biden concurred, emphasizing that Garland’s leadership was a significant error in his father’s administration.

“The single greatest mistake of my father’s administration was the leadership of Merrick Garland,” Hunter Biden asserted. He acknowledged his father, saying, “The buck has to stop with my dad. He was the president and he chose him.” Biden mentioned the adherence to a higher standard of decision-making in the DOJ, citing a division between the presidency and DOJ’s operations.

Garland’s DOJ faced criticism from Hunter Biden for its investigation into him over tax charges and a firearm’s unlawful purchase. Biden emphasized Garland’s failure to prosecute Trump concerning the Jan. 6 Capitol riots, which he labeled a “planned conspiracy” to undermine the 2020 election.

Hunter Biden questioned Garland’s decision, suggesting that a “100% legitimate investigation” was needed. He referenced the Capitol riots, questioning if Garland had truly understood the severity of actions he described as a concerted effort orchestrated by the Trump administration.

Both Welch and Hunter Biden described Garland as “moderate,” theorizing his selection was intended to appease Republicans. They alleged it was a political favor following Garland’s previous nomination for Supreme Court justice by former President Barack Obama.

In the podcast, Welch expressed that Biden played “integrity politics” in selecting Garland, critiquing Garland’s approach for not challenging certain political groups. Welch used this context to describe Garland as incapable of confronting “crusty White Republicans.” Hunter Biden agreed, labeling the choice as a “massive mistake.”

Hunter Biden had been under investigation since 2018 during the first term of former President Donald Trump. However, he received a pardon from his father during the latter’s final weeks in office, covering any potential offenses committed from January 1, 2014, to December 1, 2024.
