The administration is appealing a lower court ruling in Cook’s favor. Chief Justice John Roberts noted that President Trump could pursue Cook’s dismissal again if proper procedures were followed, including giving notice and a chance to respond. Trump has committed to taking immediate action along these lines.

A letter from White House aide Dan Scavino informed Cook that she could be removed from her position, complying with the Supreme Court’s directive for proper notice, allowing her until August 26 to respond. The attempt to remove Cook stems from accusations of mortgage fraud brought by Bill Pulte, director of the Federal Housing Finance Agency. These allegations involve Cook alleging different homes in Michigan and Georgia as her primary residences to gain favorable mortgage terms.

Cook counters these allegations, arguing they are politically motivated, claiming her actions serve the American public’s best interest. Her lawyer, Abbe Lowell, explained that Cook primarily lived in her Michigan property, justifying it as her main residence when refinancing. He also mentioned an isolated notation for the Atlanta condo as a “primary residence” was not intended for fraud.

The Trump administration’s recent letter echoes earlier claims, which Cook’s lawyer dismisses as unfounded attempts to compromise the Federal Reserve’s independence. Lowell maintains there is no legitimate basis for Cook’s removal and is prepared to contest further actions by the administration.

The case underscores the critical role of an independent Federal Reserve and the significance of preserving its autonomy within the American democratic framework.

“These allegations are as baseless now as they were a year ago when President Trump tried to remove Governor Cook and interfere with the independence of the Federal Reserve,” Lowell stated.
